Our approach to enforcement undertakings

An enforcement undertaking is a voluntary offer made by an offender to:

  • put right the effects of their offending

  • put right the impact on third parties

  • make sure the offence cannot happen again

If we accept the offer it becomes a legally binding agreement between us and the business or person who makes the offer. We will only consider accepting an enforcement undertaking for cases where:

  • it is not in the public interest to prosecute

  • the offer itself addresses the cause and effect of the offending

  • the offer protects, restores or enhances the natural capital of England

This list shows details of enforcement undertakings accepted by the Environment Agency over the last 12 months. It may include enforcement undertakings we have not published before.

Environmental Permitting (England and Wales) Regulations 2010/2016

GSM Automotive Limited (reference 581)

The offence was operating without or other than in accordance with an environmental permit (water discharge activity) – Regulation 38(1). It relates to the discharge of ferric chloride and hydrochloric acid into Emma’s Dyke, Witney between 24 and 27 August 2017.        

This was a reactive offer. The actions the offeror has taken or will take are to:

  • improve its shut down and start-up checklist
  • install a penstock valve to drain in the yard
  • install a high-level alarm and ‘call-out’ rota
  • pay third parties for costs incurred as a result of the incident
  • cover the Environment Agency’s costs

They will contribute £10,000 to The Woodland Trust.

This enforcement undertaking was accepted on 2 November 2023.

Yorkshire Water Services Limited (reference 657)

The offence was operating without or other than in accordance with an environmental permit (water discharge activity) – Regulation 38(1). It relates to incidents involving a water discharge activity not authorised by an environmental permit at Melbourne sewage treatment works on 21 May 2018.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • pay tankering costs
  • repair sludge holding tank pipework
  • employ a consultant to carry out surveys
  • install secondary containment
  • assess all sites where there is site drainage and carry out dye-tracing
  • provide interim refresher training
  • cover the Environment Agency’s costs

They will contribute £200,000 to Yorkshire Wildlife Trust.

This enforcement undertaking was accepted on 30 January 2024.

Cleansing Service Group Limited (reference 799)

The offence was failure to comply with a permit condition (installation activity) – Regulation 38(2). It relates to an incident involving an explosion caused by an unknown chemical in breach of an environmental permit condition at CSG Lanstar Cadishead site, Manchester on or around 22 December 2020.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • amend its procedures so that customers ensure all small packs are identified prior to collection
  • store any small, unmarked containers in a segregated, fire-resistant store until the necessary changes are made to its processes and procedures for the small packs treatment facility (SPTF)
  • review and update its policies and procedures to minimise the potential for small, unmarked containers with unknown contents to be received at SPTF
  • put in place interim quarantine measures
  • review its position and approach to unidentified hazardous wastes
  • involve its employees in the SPTF in the development of new procedures
  • monitor compliance with the revised procedures
  • investigate the incident and take steps to make sure it cannot happen again, including assigning a responsible person for ensuring that the actions outlined in this enforcement undertaking are complied with within the relevant timeframe
  • support the member of staff affected by the incident
  • cover the Environment Agency’s costs

They will contribute £25,000 to The Kindling Trust.

This enforcement undertaking was accepted on 27 March 2024.

Severn Trent Water Limited (reference 872)

The offence was operating without or other than in accordance with an environmental permit (water discharge activity) – Regulation 38(1). It relates to pollution caused by a discharge of sewer liquor into Dimore Brook, Gloucester on or around 19 August 2021.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • flush Dimore Brook and carry out river sampling
  • clear the blockage which caused the incident
  • carry out a CCTV survey of the sewer
  • repair the defect in the manhole
  • carry out an expert electrofishing survey
  • cover the Environment Agency’s costs

They will contribute £327,500 to Gloucestershire Wildlife Trust.

This enforcement undertaking was accepted on 8 November 2023.

Sembcorp Utilities (UK) Limited (reference 883)

The offence was failure to comply with a permit condition (installation) – Regulation 38(2). It relates to inadequate sampling and analysis operating systems at its biomass power station at Wilton, Teesside, resulting in the misclassification of its incinerator bottom ash (IBA) between 2015 and 2019.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • dispose of all IBA waste at a hazardous waste landfill site
  • review and update the process for the disposal of waste materials
  • revise documents to better capture and standardise IBA sampling processes, including the collection of IBA samples, IBA sampling and testing plan, and instructions to collect the IBA samples
  • carry out a board review of its approach to environmental compliance assurance and use of enhanced reporting
  • arrange for 15 senior managers to attend a directors one day training course
  • ensure senior staff at Sembcorp have undertaken appropriate environmental qualifications
  • create an additional full-time environmental management role
  • cover the Environment Agency’s costs

They will contribute £290,000 to Tees Valley Wildlife Trust.

This enforcement undertaking was accepted on 23 November 2023.

Reckitt Benckiser UK Limited (reference 890)

The offence was operating without or other than in accordance with an environmental permit (water discharge activity) – Regulation 38(1). It relates to pollution caused by a discharge of aerosol production plant trade effluent into Cuttle brook, Derby between 10 and 12 August 2021.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • implement extensive pollution incident response measures and long-term remedial measures
  • reorganise the transfer of effluent
  • complete a drainage programme
  • monitor discharge consents
  • carry out a corporate audit with external oversight
  • review existing systems
  • cover the Environment Agency’s costs

They will contribute £150,000 to East Mercia Rivers Trust.

This enforcement undertaking was accepted on 8 November 2023.

Axil Integrated Services Limited (reference 932)

The offence was failure to comply with a permit condition (installation) – Regulation 38(2). It relates to breaches of the environmental permit conditions concerning management systems at Cannock Industrial Centre, Staffordshire on or around 2 September 2022.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • carry out a director review into the cause of the breaches and plan to prevent recurrence, including no longer accepting the waste stream containing the calcium oxide in the packaging at the site
  • brief staff on storage of moisture sensitive wastes and aerosols
  • deliver a formal “toolbox talk” on storage of moisture sensitive and aerosol wastes
  • review the company’s environmental management system including pre-acceptance, acceptance and storage procedures
  • issue procedures to staff to read and confirm understanding
  • develop amended label system to identify more clearly moisture or water reactive wastes that need to be stored under cover
  • hold on-site discussions to enhance the technical knowledge and experience of the chemists involved in waste acceptance and appoint new senior chemists
  • appoint a new supply chain manager
  • install thermal detection security cameras to cover the yard
  • deploy industrial services team for redrumming, jet washing and interceptor maintenance
  • hire a grab lorry
  • dispose of fire-fighting water
  • replace diesel bowser
  • refill diesel bowser
  • replace and install emergency shower
  • install temporary replacement lighting on yard
  • install permanent replacement lighting and rerouting some cables
  • repair damaged concrete
  • remove damaged steps and other metalware for disposal
  • develop containment walls around outgoing bay
  • repair or compensate third parties for damage to their property
  • engage with local residents to discuss ongoing concerns
  • cover the Environment Agency’s costs

They will contribute £100,000 to The Wildlife Trust for Birmingham and the Black Country.

This enforcement undertaking was accepted on 4 April 2024.

Amic Haulage Limited (reference 957)

The offence was operating without or other than in accordance with an environmental permit (water discharge activity) – Regulation 38(1). It relates to pollution caused by a discharge of milk into a tributary of the River Wheelock, Crewe on or before 8 November 2020.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • monitor vehicles and tankers on site
  • relocate parking area
  • issue a termination notice to the contractor
  • use sand to soak up some of the spillage
  • cover the Environment Agency’s costs

They will contribute £2,500 to Mersey Rivers Trust.

This enforcement undertaking was accepted on 4 March 2024.

C P Button Limited (reference 962)

The offence was operating without or other than in accordance with an environmental permit (water discharge activity) – Regulation 38(1). It relates to a silage leachate pollution to the River Allen from Polshea Farm, Bodmin on 29 June 2022 and a slurry pollution at Bokelly Farm, Bodmin on 4 March 2023.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • identify the source of effluent leak and block the pipeline
  • carry out silage pit repairs
  • install a drainage channel beside the silage pit
  • improve slurry spreading procedures by providing operators with an up to date digital map
  • plant 2.3 kilometres of 6 metre buffer strips in areas at risk of runoff
  • cover the Environment Agency’s costs

They will contribute £8,000 to Westcountry Rivers Trust.

This enforcement undertaking was accepted on 21 February 2024.

Glaxo Operations UK Limited (reference 964)

The offence was operating without or other than in accordance with an environmental permit (water discharge activity) – Regulation 38(1) and failure to comply with a permit condition (water discharge activity) – Regulation 38(2). It relates to an incident involving a water discharge activity or groundwater activity not authorised by an environmental permit at its Ulverston site, Cumbria between 6 and 9 March 2021.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • stop all site activities pending full site investigation
  • carry out assurance checks of the leak area and crude acetone line
  • improve pipework labelling to clearly identify live and decommissioned pipework
  • conduct assessment of current pipework labelling condition on hazardous fluid systems
  • implement control and automation (C&A) to monitor solvent transfers between production and site storage tanks
  • increase planned management monitoring
  • implement robust communication between production and site storage tanks for solvent transfers
  • enhance shift management systems on site to enhance co-ordination between departments when investigating atypical events
  • carry out face-to-face training to cover operational and C&A controls
  • carry out comprehensive testing of full environmental impact of incident
  • remediate the site to the condition prior to this spillage
  • cover the Environment Agency’s costs

They will contribute £200,000 to Cumbria Wildlife Trust.

This enforcement undertaking was accepted on 24 June 2024.

Royal Mail Group Limited (reference 966)

The offence was operating without or other than in accordance with an environmental permit (water discharge activity) – Regulation 38(1). It relates to a diesel pollution of Billing Marina and the River Nene at Billing Aquadrome, Northampton on or about 26 April 2020.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • empty the residual fuel, decommission and dispose of the tank
  • carry out extensive clean-up works, including further minor works and monitoring
  • cover the Environment Agency’s costs

They will contribute £150,000 to Nene Rivers Trust CIO.

This enforcement undertaking was accepted on 31 January 2024.

Severn Trent Water Limited (reference 972)

The offence was failure to comply with a permit condition (water discharge activity) – Regulation 38(2). It relates to the discharge of effluent from Brooks Lane Pumping Station, Whitwick into a tributary of West Meadow Brook, Leicestershire on or before 12 September 2022.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • update its standard operating procedure (SOP)
  • improve the communication process between Operations and Network Control around alarm monitoring
  • establish a dedicated team to actively monitor and take ownership of all telemetry issues
  • introduce standby out of hours service for telemetry
  • cover the Environment Agency’s costs

They will contribute £600,000 to Trent Rivers Trust.

This enforcement undertaking was accepted on 22 July 2024.

The offence was operating without or other than in accordance with an environmental permit (water discharge activity) – Regulation 38(1). It relates to a contaminated fire-water pollution of the River Great Ouse at Brackley, Northamptonshire on or about 27 June 2018.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • employ a waste management company to provide multiple hazardous waste removal services following the fire
  • employ a waste management company to ensure that the contaminated fire waters were disposed of appropriately without further incident
  • instruct a consultant to conduct an investigation at the site to better understand the incident and learn from it
  • close the site and bolster its infrastructure and procedures at another site
  • improve the fire safety equipment at another site
  • employ an external specialist to provide additional staff training and carry out a fire risk assessment at another site
  • install a new fire alarm at another site
  • review the entire compliance program and implement new measures regarding pollution prevention and fire prevention
  • pay for restoration works related to impacted third party
  • cover the Environment Agency’s costs

They will contribute £11,038 to Canal & River Trust.

This enforcement undertaking was accepted on 27 November 2023.

Lilburn Estates Farming Partnership (reference 986)

The offence was operating without or other than in accordance with an environmental permit (water discharge activity) – Regulation 38(1). It relates to an incident involving a spill of nitrogen fertiliser from a storage tank at West Horton Farm, Northumberland which discharged into Horton Burn on 26 April 2023.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • carry out a comprehensive investigation into the existing procedures, the equipment and machinery involved in the incident
  • arrange meetings with sprayer operators to make sure they are using the correct method of emptying the fertiliser tank
  • implement a new procedure whereby operators are required to disconnect and reconnect the pipe and lock after every extraction rather than at the end of the working day
  • implement additional improvement measures to tanks, including the construction and fitting of bunds around the 2 remaining un-bunded tanks
  • increase supply of spare locks to make sure existing locks can be quickly replaced in the event that they become corroded
  • arrange for all pipes to be fitted with universal joints to prevent any issues of incompatibility and ensure that all pipes can be used interchangeably with all tanks if required
  • carry out regular spot inspections of the fertiliser tanks to make sure the correct procedure is being effectively followed
  • cover the Environment Agency’s costs

They will contribute £4,752 to The Tweed Foundation.

This enforcement undertaking was accepted on 29 April 2024.

BDW Trading Limited (reference 989)

The offence was operating without or other than in accordance with an environmental permit (water discharge activity) – Regulation 38(1). It relates to a silt pollution of the Ladden Brook and Tanhouse Stream from Ladden Garden Village housing development at Yate, Bristol between 21 and 27 July 2022.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • install a drainage ditch filled with aggregate and geotextile to provide a lined discharge route for any water discharging from the sustainable urban drainage system (SuDS) basin located next to the relevant watercourse
  • increase ground levels around the northern edge and a soil bund along the eastern bank to provide additional storage capacity
  • deploy silt capture matting to provide additional sediment capture capacity
  • refresh and maintain drainage ditch protection measures
  • implement active water treatment
  • issue a new safety, health and environment (SHE) alert at all sites explaining the risks and best practice around surface water management
  • provide refresher training for site managers across the business and groundworks contractor senior staff
  • provide refresher environmental training for the technical department
  • provide a “toolbox talk” to the site senior management team for all staff and sub-contractors
  • provide an updated surface water management plan
  • employ a consultant to carry out testing and sampling and reoccurring quarterly inspections
  • carry out works to clear the ditches and stream of all sediment deposits and construct gabion baskets at strategic locations and outfalls
  • retain 2 gravity sediment filter pumps on site and obtain new gravity sediment filter pumps
  • reinforce or renew all sediment interception controls at all drainage outfall locations and intermediate mid-ditch locations in the relevant area
  • renew all road gully bags and empty gully pits
  • close the site’s hydrobrakes to restrict the flow of water and control the flow of sediment
  • install headwall protection across the inlet and outlet headwalls
  • install silt fencing along sections of surface water ditches
  • use road sweepers and drive on/off wheel wash facilities
  • maintain vegetated surfaces in non-active construction areas
  • install reptile fencing around the perimeter of the development site
  • circulate details explaining remedial actions where identified in monthly inspections
  • send notifications when rainfall is predicted to ensure silt management is in place
  • cover the Environment Agency’s costs

They will contribute £201,500 to:

  • Bristol Avon Rivers Trust (BART) (£165,000)
  • Tortworth Forest Centre (community interest company) (£11,500)
  • Avon Wildlife Trust (£25,000)

This enforcement undertaking was accepted on 29 January 2024.

F R Hill and Son (reference 1000)

The offence was operating without or other than in accordance with an environmental permit (water discharge activity) – Regulation 38(1). It relates to a slurry pollution at Cat Hill Clough and Rons Cliff Dike, Hoylandswaine, Sheffield on 25 April 2022 and 24 January 2023.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • attach an additional pipe to the slurry store
  • install an overload sensor to the slurry store
  • pressure wash the slurry store before fitting a liner
  • line the weeping wall slurry store with 3mm geomembrane lining
  • break and remove concrete on 2 feed yards, reinstate storm and land drains, two inspection pits/silt traps and concrete yards
  • install a new rainwater collection tank and rainwater filtration and diverter
  • carry out environmental improvement works, including woodland creation, pond restoration, wildlife habitat creation and planting new hedgerow
  • cover the Environment Agency’s costs

This enforcement undertaking was accepted on 9 July 2024.

P J R Blewitt Limited (reference 1006)

The offence was operating without or other than in accordance with an environmental permit (waste operation) – Regulation 38(1). It relates to the disposal of waste soils at Tynely Farm, Northumberland between 15 January and 11 April 2019.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • update waste transfer notes
  • apply for a new permit and update the environmental management system (EMS) to allow on site waste processing
  • provide duty of care and compliance training and environmental permitting operator’s certificate (EPOC) and Waste Management Training and Advisory Board (WAMITAB) qualifications
  • cover the Environment Agency’s costs

They will contribute £3,000 to Northumberland Wildlife Trust.

This enforcement undertaking was accepted on 13 February 2024.

Mick George Limited (reference 1013)

The offence was failure to comply with a permit condition (installation) – Regulation 38(2). It relates to the failure to comply with an approved scheme of operator competence across numerous sites in East Anglia, England between 31 May and 1 November 2019.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • provide technically competent management (TCM) cover through a centrally managed process, on a day to day and site by site basis
  • log TCM hours on a spreadsheet
  • monitor the TCM spreadsheet on a daily basis
  • cover the Environment Agency’s costs

They will contribute £40,000 to Leicestershire and Rutland Wildlife Trust.

This enforcement undertaking was accepted on 28 March 2024.

Frimstone Limited (reference 1014)

The offence was failure to comply with a permit condition (installation) – Regulation 38(2). It relates to the failure to comply with an approved scheme of operator competence across numerous sites in East Anglia, England between 31 May and 1 November 2019.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • provide TCM cover through a centrally managed process, on a day to day or site by site basis
  • log TCM hours on a spreadsheet
  • monitor the TCM spreadsheet on a daily basis
  • cover the Environment Agency’s costs

They will contribute £15,000 to Leicestershire and Rutland Wildlife Trust.

This enforcement undertaking was accepted on 28 March 2024.

Neil Johnson (reference 1015)

The offence was failure to comply with a permit condition (installation) – Regulation 38(2). It relates to the failure to comply with an approved scheme of operator competence across numerous sites in East Anglia, England between 31 May and 1 November 2019.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • provide TCM cover through a centrally managed process, on a day to day or site by site basis
  • log TCM hours on a spreadsheet
  • monitor the TCM spreadsheet on a daily basis
  • cover the Environment Agency’s costs

They will contribute £5,000 to Leicestershire and Rutland Wildlife Trust.

This enforcement undertaking was accepted on 28 March 2024.

Andrew Johnson (reference 1020)

The offence was operating without or other than in accordance with an environmental permit (waste operation) – Regulation 38(1). It relates to the operation of a regulated facility, namely a waste operation for the disposal of waste, at Tynely Farm, Northumberland between 18 March and 11 April 2019.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • stop operations and not resume without express Environment Agency approval
  • cover the Environment Agency’s costs

They will contribute £1,400 to Northumberland Wildlife Trust.

This enforcement undertaking was accepted on 11 June 2024.

Richard Hesketh (reference 1031)

The offence was operating without or other than in accordance with an environmental permit (waste operation) – Regulation 38(1). It relates to the deposit of mixed waste beneath Junction 1 of the M53, Wirral, Merseyside on 9 September 2021.

This was a reactive offer. The actions the offeror has taken or will take are to:

  • resign as a company officer and dissolve the company
  • pay third party for clean-up costs
  • cover the Environment Agency’s costs

This enforcement undertaking was accepted on 22 May 2024.

Salmon and Freshwater Fisheries Act 1975

Maker Industrial Products Limited (reference 840)

The offences were failure to:

  • register – Regulation 40(1)(a)
  • take reasonable steps to recover and recycle packaging waste – Regulation 40(1)(b)

They relate to failure to comply for registration years 2017 to 2019 (register) and 2018 to 2019 (recover and recycle) inclusive.

This was a proactive offer. The actions the offeror has taken or will take are to:

  • register with Valpak compliance scheme
  • assign a responsible person for data submissions
  • introduce new methodology and internal processes
  • cover the Environment Agency’s costs

They will contribute £9,530.31 to Ribble Catchment Conservation Trust (Ribble Rivers Trust).

This enforcement undertaking was accepted on 13 February 2024.

JYSK Limited (reference 850)

The offences were failure to:

  • register – Regulation 40(1)(a)
  • take reasonable steps to recover and recycle packaging waste – Regulation 40(1)(b)

They relate to failure to comply for registration years 2010 to 2020 inclusive.

This was a proactive offer. The actions the offeror has taken or will take are to:

  • register with REPIC compliance scheme
  • introduce new packaging waste process document
  • assign responsible person(s)
  • implement a new budget process
  • cover the Environment Agency’s costs

They will contribute £31,757.62 to Keep Britain Tidy.

This enforcement undertaking was accepted on 21 November 2023.

Rosewood Pet Products Limited (reference 879)

The offences were failure to:

  • register – Regulation 40(1)(a)
  • take reasonable steps to recover and recycle packaging waste – Regulation 40(1)(b)

They relate to failure to comply for registration years 1999 to 2019 inclusive.

This was a proactive offer. The actions the offeror has taken or will take are to:

  • register with a compliance scheme
  • introduce full written procedures
  • make sure product managers are fully competent in keeping systems updated
  • assign responsible person(s) for checking and correcting data
  • assign a nominated person for monitoring and reporting environmental compliance
  • carry out data collection and calculation at the start of each calendar year
  • implement director-level checks and sign-off

This enforcement undertaking was accepted on 6 February 2024.
